1. Acceptance of these Terms

By accessing or using an ASQ Empowerment Services (“ASQ,” “we,” “us,” or “our”) website, form, application, digital resource, program, or related service, you agree to these Terms of Service.

If you do not agree with these Terms, please do not use the affected website or service.

2. About ASQ services

ASQ provides leadership-development experiences, organizational services, speaking and facilitated learning, publications, digital resources, and related services.

Specific programs, organizational engagements, speaking engagements, memberships, purchases, or other services may be subject to additional written terms. If a separate signed agreement conflicts with these general Terms, the separate agreement controls for that engagement.

3. Educational and developmental nature of the work

ASQ provides education, leadership development, facilitation, and organizational support. Unless expressly stated otherwise in a separate professional agreement, ASQ content and services do not constitute medical, mental-health, legal, financial, or other licensed professional advice.

The ASQ Practice and related leadership-development services are not therapy and are not substitutes for clinical care.

4. Applications and program participation

Some ASQ programs may require an application, fit conversation, or other review before enrollment. Submitting an application does not guarantee acceptance, placement, membership, or enrollment.

ASQ may consider readiness, fit, scheduling, group composition, available capacity, and other relevant factors when determining participation.

5. Fees, billing, cancellation, and refunds

Fees, billing frequency, cancellation provisions, refund terms, and other purchase conditions presented at checkout, during enrollment, or in a separate written agreement apply to the relevant purchase or service.

You are responsible for reviewing those terms before completing a purchase or enrollment.

6. No guarantee of specific results

ASQ is committed to useful, practical work, but leadership development and organizational improvement depend on many factors, including participation, context, application, practice, decisions, and conditions outside ASQ’s control.

We do not guarantee a particular personal, professional, organizational, financial, cultural, or performance outcome from a website, keynote, workshop, program, membership, resource, or single intervention.

7. Intellectual property

Unless otherwise stated, ASQ owns or licenses the content, curriculum, frameworks, graphics, designs, recordings, written materials, downloads, and other materials made available through our websites and services.

You may use ASQ materials for your own lawful personal or internal organizational use when that use is part of the service provided. You may not reproduce, publish, sell, redistribute, sublicense, publicly present, create derivative commercial products from, or otherwise exploit ASQ materials without permission.

8. Acceptable use

You agree not to use ASQ websites or services to:

• Violate applicable law or the rights of another person.
• Attempt unauthorized access to systems, accounts, or information.
• Introduce malicious code or interfere with website or service operation.
• Misrepresent your identity or relationship with ASQ.

ASQ is not responsible for the independent terms, policies, content, availability, or practices of third-party providers.

12. Availability and changes

We may update, modify, suspend, or discontinue website features, digital resources, or service components when reasonably necessary. Program-specific commitments already made to a client or participant remain subject to the applicable enrollment or written agreement.

13. Disclaimer

To the extent permitted by applicable law, ASQ websites and general digital content are provided on an “as available” basis. We make no guarantee that every website feature will be uninterrupted, error-free, or available at all times.

14. Limitation of liability

To the maximum extent permitted by applicable law, ASQ Empowerment Services will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, our public website or general digital content.

Nothing in these Terms excludes liability that cannot lawfully be excluded. Additional liability provisions may apply under a separate signed service agreement.

15. Termination or restriction of access

ASQ may restrict access to a website, program, resource, or service when reasonably necessary to address misuse, nonpayment, safety, material disruption, violation of these Terms, or other legitimate operational concerns, subject to any separate agreement that applies.
